The Basics

Jivve respects the intellectual property rights of others and expects our users to do the same. This Copyright Policy explains how we handle copyright infringement claims and what you should know about posting content on our platform.

BLKQ LLC ("Jivve," "we," "us," or "our") complies with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws.

You Own Your Stuff

When you post content on Jivve, you retain ownership of your intellectual property. However, you grant us a license to use, display, and distribute your content on the platform.

What You Own

  • You own the copyright to original content you create and post
  • You control who can use your content outside of Jivve
  • You can delete your content at any time

Don't Be A Thief

Only post content that you own or have permission to share. This includes:

  • Photos and videos: Don't post someone else's photos or videos without permission
  • Music and audio: Don't use copyrighted music in your posts without proper licensing
  • Text and writing: Don't copy and paste articles, blog posts, or other written content
  • Artwork and designs: Don't share others' creative work without credit and permission

Snitch on The Thieves (DMCA)

If you believe content on Jivve infringes your copyright, you can file a DMCA takedown notice. Your notice must include:

  1. Your physical or electronic signature
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the material that is claimed to be infringing (with URL or location)
  4. Your contact information (address, telephone number, email)
  5. A statement that you have a good faith belief that use of the material is not authorized
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

Counter-Notification

If your content was removed due to a DMCA claim and you believe the removal was mistaken, you can file a counter-notification. Your counter-notice must include:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and its location before removal
  3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  4. Your name, address, and telephone number
  5. A statement that you consent to jurisdiction of the Federal District Court

Send counter-notifications to the same address as DMCA notices above.

Repeat Infringer Policy

Jivve will terminate accounts of users who repeatedly infringe the copyrights of others. We maintain a three-strike policy:

  • 1.First violation: Content removed and warning issued
  • 2.Second violation: Temporary account suspension
  • 3.Third violation: Permanent account termination

Fair Use

Some uses of copyrighted material may be considered "fair use" under copyright law. Fair use factors include:

  • The purpose and character of the use (commentary, criticism, news reporting)
  • The nature of the copyrighted work
  • The amount used in relation to the whole work
  • The effect on the market value of the original work

Fair use is determined on a case-by-case basis. If you're unsure, it's best to obtain permission or create original content.
